I wanna sue someone using a small claims court, how do i go about doing that?
He lost (or refuses to return) my cell phone and promised to pay for it, now he is refuse to. I have saved text messages as proof that he did own he was going to pay for it, and i also have record messages from him saying that he refused. I asked for money (so he didnt have to verbs about actually buying it) and he refused that as resourcefully... i wanna take it up with a judge or anyone who can of late get me the money for my phone... what steps should i take? i am using my old phone at the moment. I swtiched the service to an elder phone and continued talking to him (hence the texts i now hold from him)

Check with your local magistrate/judge within your area. They usually have the necessary paperwork for you to overrun out. It will cost to file this complaint with the small claims court.

If what you are saying is true that you own text messages on the phone he refuses to return then how are going to guard your self in court he has the phone. Question do you think he going to paw the phone over to you, I think not. Do you have a written agreement regarding the phone and are near any repayment stipulation in your contract. A verbal contract is hearsay, there is no access that can be used to affirm what you or he said. Now what you can do is stop contract on the phone, yes. It will cost you but then it might work for your defense. Get it! It will show all phone calls made contained by time frames leading up to your complaint. Then you can pursue him in small claims.
