Hipaa Violation???????


I was in the hospital and signed that the hospital was to discuss beside my time there with no one. After the reality I found that my doctor was speaking to my husband about my treatment, telling him things I be saying and revealing to him that I'd been treated at the Mental Health portion of the hospital years before. An administrator is looking into this, but since Friday dark I was told about my mental health treatments (which he didn't even know more or less, they were so long ago.) Is there a spousal exclusion under Hipaa?

No. If you specify who can and cannot enjoy access to your health information and the doctor violates that by giving information without your blessing, then he's violated HIPAA. On the other hand, if you gave go-ahead for the doctor to speak to your husband and you didn't specify that you did not want him to know about your mental health history, you can't do much.
