Father in UK paid no Child Support for 11years. Can anything be done?
My ex was granted custody of our only son and took him to live with him surrounded by his home city in the UK. After two years he returned my son to me in Canada citing that he was unmanageable and if I did not appropriate him he was to be placed in a home. I took him and found that he was artificial with mutiple Psychlogical and mental disorders. Despite treatment and professional interventions nothing has really worked, my son is presently 25yrs old and lives at home unable to work.
For all these years I (a single parent) have to work and try to cope with a desperate situation the best I could. In our original divorce decree contained by Canada I was granted $500 a mth in child support which my ex never paid me. I allowed him to whip custody of our child because I was having difficulty managing him and my husband seemed to prudence for him and had a large family make friends to support him in bringing him up in the UK.
I have never have a penny of support and I feel it is very, very excessive. Can we seek back payment or sue?
Yes, I believe you can. But the big press is, will it be worth it?
This will be a very lenghty and complicated process. It will certainly entail more than one canon suit, which mean more costs. Some of your agruments might have become dilluted by the fact that you consent to your ex. have the custody of your son for two years, thus declaring yourself incompetant as a parent. This makes your covering for back payments very weak. I do believe, however, that if you can prove negligence, and mental anguish because of the mistreatment of your son by your husband, etc. afterwards you have a case. It could involve claims for child support, may be child abuse (A criminal case), and compensation for mental stress on you as a soul. This will probably require filing in the UK as well. But that happen only after the Canadian courts rule in your favour and issue an extridition demand for your ex. husband to appear. It will become further complicated by the fact that he may not have the money to give you what you are looking to collect. So the big interrogate is, is it worth it?
