California VC 23222 question?
In California you can have up to an once of marijuana in your car and the maximum punishment is $100. I be caught with approx. 2 grams and haven't gone to court yet. I am 18 but someone told me that its only $100 ticket if your 21 and I can facade a harsher punishment such as losing my license for a year. I searched online but i couldn't find anything going either way. Can someone please clarify this for me?
Best Answer:
It is a $100.00 fine and age have nothing to do with it. If you get caught three or more times in a two (2) year period you could end up in a program or lock away. That's it. I was looking for the statute but bumped into it by accident anyway so here it is: http://www.californiaduihelp.com/california_dmv/vc23222.asp
If you are under 21, any drug (or alcohol) offense (whether or not it involves a vehicle) can result within a 1 year license suspension. (Veh C 13202.5.) That is obviously a more serious consequence than the fine. Since this charge is a misdemeanor (even though punishable by a fine only), you are entitled to appointed counsel if you cannot afford counsel. There are alternatives to conviction, and it would be a good idea to hold an attorney to guide you an help save your license.
