I was just served:Small Claims court for a fender bender after the insurance company said it was not my fault?


Myself and another woman were backing out of our parking spaces (parking lot) and we hit back bumpers. No injury to my car but her car has a small chisel on her bumper. My insurance co. told me that the decision was 50/50 with me have 0% liability. The guy decided not to go through his auto insurance company and is taking me to court for $800 rather than paying his $500 deductible. I own never been in an auto accident and never be to small claims court. Does anyone have nay advice for me? Thank you in credit!

Call your insurance company, they should be capable of take care of this for you. Because you had insurance he should not be capable of go through you, he needs to go through your insurance.

Notify your liability insurer. They will hire the lawyer to defend you. That is why you have insurance. The feelings of your insurer means nothing to the court, but the policy still requires the insurer to defend you and wages any judgment
Was there any police report file? if so, take that. also take all the papers from your insurance company. Simple state that that your insurance company believe you hold zero responsibility as it was also his fault. Unfortunately anyone can drag anyone to small claims court..that doesn't be determined they always win. Good luck and take care. I hope you win.

Call your insurance company. They should be helping you to fight/settle this. Remember, only because your insurance company decided you had 0% liability does not mean the court will want the same way.
if you do not income they will find a way like garnishing wages or taking property
Bring the insurance company letter. Impress on the judge that it is not the case that you back into him, but that you backed into each other and this letter verify your claim.
People don't know WHAT they are talking about on here. NO he cannot take your property or garnishing your wages. He is gonna lose the case because the insurance said it was 50/50, and he can't prove it was YOUR bad habit 100%, and he HAS too, the burden of proof is on the Plaintiff. Don't worry. Plus he has to pay, and will lose, similar to twenty bucks for the court fee.
Your insurance company should be dealing with him. Small claims court requires that both parties agree to small claims court. If you don't agree, he'd enjoy to get a lawyer and go to genuine court.
