What happens to my child support if my ex got fired?


My ex husband pays court ordered child support for our 2 year old daughter. They were garnishing it directly from his paycheck that he no longer receives. He refuse to pay the clerk and claims he doesn't have the money. What actions am I responsible for taking to see to it that my daughter get the money that the court ordered? Do I need to file anything... or will the court see that he hasn't paid and hold him within contempt? We live in Indiana if that helps or matters.

Have you ever hear the expression, "You can't get Blood from a STONE"? WHERE do you expect him to get the Money from, having NO JOB? What chunk of, "he doesn't have the money" don't you understand.. When/IF he gets another Job after you can go to Court to ORDER him to Pay! Until he has a Job AND you know where he is working, nearby isn't much you can do.

I agree with Trouble above. He is correct, no job, no $. If he applied for dismissal benefits, child support can take a part of that but that's it.
You can go to the clerk of courts where the original charge was filed - explain what happens - near really is nothing you/he can do until he gets a new undertaking. Maybe you should see if you can help him find a new job - he will verbs to owe the support amount when/if there is a modification.
The court can no problem hold him in contempt, but for this the court usually must have before it a motion to enforce your child support writ. The child support order may be in your divorce decree. You can directory a motion to enforce, for which you'll probably need a lawyer, or the child-support authority in your state can do it for you -- this is usually the state Attorney General. He can plead that he should not be held within contempt because he doesn't have the money to pay, but the court, your lawyer, or the Attorney General should require him to show what attempts he's made to go and get another job and whether he got any severance pay from the employer that fired him. I support you to call child protective services and ask them which agency enforces child-support orders, after contact them and tell them the problem. Good luck!
