Are "trespassers will be shot" signs really legal?

I'm in this debate with a friend of mine over this, and she's saying that it's your right to shoot at (but not necessarily to kill) anybody that trespasses on your ground, and she used the argument that snipers are guarding the white house. I mean, it can't be legal, right? Alright, so they're legal. Are in attendance any limitations? Do you have to warn the person, or can you merely shoot them?
Best Answer:
Of course the SIGNS are legal, they are nothing more than a limiting. However, simply shooting someone who trespasses on your land is another story altogether. In the majority of states, you are only allowed to use, "reasonable force," in connection with trespassers, especially on land versus inside your home or dwelling. Some states such as Florida, Texas, Kentucky, Alabama, Tennessee, Louisiana, and several more, have adopted the, "Castle Doctrine," which define the use of force and/or deadly force regarding trespassers. But the provisions vary widely state to state. Your friend have better become more informed with the law in your state since, "jumping the gun," and advising others or someone is likely to shutting up in jail. It's much more complicated than she thinks.
No, they are legal. Depending on where you live, if someone trespasses on YOUR property - by imperative - you have the right to shoot them. The signs seem like they are adjectives in good fun and just a practical joke. However, they are more or less a warning that the person will cart law into their own hands and shoot you if you trespass. So, yeah, if you see a sign like that - DO NOT urge the person. Read this article. It is about how a SEVEN year old boy get shot to death because he trespassed. The people had a sign that said they'd shoot if anyone trespassed. I guess he literary the hard way. http://news.aol.com/article/7-year-old-boy-dies-in-trespass-shooting/472454 - Nope, no limitations whatsoever. You don't have to caution them. The person already committed a crime by invading in your personal property. You have the right to uncovered arms and protect your land - so says the law and Constitution.
They are legal. And the sign is your warning.
Ya they are legal. but sometimes they shoot people and then they achieve sued by the family so its a win lose sitiuation
They are not legal. Except in some cases in Texas. In the story tabled, they were charged with crimes and if someone dies from the shooting, murder. That is the facts. There has to be some sort of threat to use deadly force.

Sure the sign is trial, but in most states, it is illegal to shoot a person if they come onto landscape. However, if a person breaks into a house, then it is legal. There be a case where someone broke into a barn, the farmer saw it and shot him, the creature who was breaking in did not die. However, the farmer be charged and convicted with attempted murder, and assault with a deadly weapon. On appeal, the judgment was upheld.
Not only are the signs legal, it is also a officially recognized defense to homicide (in some states) that the victim was trespassing, knew he be trespassing, and had been warned to move. (Maine, for example) The Texas case has nothing to do next to this, as the victims were not trespassing. One could argue that the signs are "threats of violence", but that violence could also be legal, lower than the right circumstances.
It is not trial to shoot a trespasser. Civil liability law states that you cannot intend to harm trespassers--you can't place land mines surrounded by your yard so that if anyone walks in they die. You can't verbs holes and cover them with leaves. And so on. If you do those things, and the trespasser sues, you will be liable for monetary damages. In the vast majority of states, you cannot injure someone who is trespassing in your home unless you are within physical danger. This means that you cannot shoot a harmless trespasser or even a non-violent burglar. The lone exception to this is in Texas. In Texas, you can shoot a burglar who is attempting to run away with your property if that is the solely way you will be able to recover your property. If you read the article that the first personage listed, the people who shot the child were charged next to aggravated assault, which was expected to be upgraded to murder.
it's decriminalized.
Yes you have the right with deathlike force. Read this link
The signs are (lol) but you'll still go to jail for murder. Think nearly situations when someone might accidently wander onto a large piece of property without clear boundaries. What in the region of a drunk or homeless guy sneaking into a building to escape the cold? Only jerks put signs up like that (sorry) buit it's freedom of speech. P.S. I just read the article that guy posted. Those populace are being charged with 2nd degree murder, so my point still stands !
Texas Couple to Face Murder Charge for Shotgun Blast at Car that Killed Boy Sign Outside Home of Gayle and Sheila Muhs Warns 'Survivers Will Be Reshot' By SARAH NETTER May 11, 2009 Gayle and Sheila Muhs give trespassers a blunt warning. They posted a large sign outside their Texas home saying trespassers would be shot and survivors would be shot again. Police enunciate Gayle and Sheila Muhs could face murder charges after they opened fire on two vehicles concluding week, killing a 7-year-old boy. (ABC News)They weren't joking. The Muhs are currently being held on charges of aggravated assault for allegedly firing at most minuscule two shotgun blasts at a pair of packed cars that stopped outside their rural Texas house. Those charges are expected to be upgraded to murder, since a 7-year-old boy who was wounded within the assault has died from shotgun pellets to his head and facade. But police said the families in the two cars were driving on a public road when the Muhs open fire from their house, killing Donald Coffey Jr. and hitting three others, including the boy's 5-year-old sister. Outside the Muhs' house is a handpainted sign complete with misspelling and exclamation points that warns: "Trespassers Will Be Shot. Survivers Will Be Reshot!! Smile I Will." Liberty County Sheriff's Department Chief Deputy Ken DeFoor told ABCNews.com today that the shooting be the most "violent reaction to something so blatantly, blatantly minor" he's ever seen. Police get a 911 call just after 9 p.m. Thursday, DeFoor said, from Sheila Muhs who "reported there be people in jacked up four-wheel automobiles ... and that she shot them." She also reported that the vehicles be destroying the nearby levees. But in reality, DeFoor said, the family in the two cars had done nothing crooked. And, he said, they never set foot on the Muhs' property. This answer your question?
As I was always qualified when I was raised, if a burglar comes into your house, even if he intends no harm, shoot him, and build sure he is dead, so he cant live to sue you. how in hell do they get away next to suing you? what has the world come to...
