custody question, please help!?
I have my daughter (5) in my custody, She has lived next to me in Colorado her whole life. Her father moved 250 miles away when I be pregnant, I had little contact with him the first 3 years, the last 2 years he have been driving to see my daughter for supervised visits. 6 months ago I took a temp job and moved to where on earth he is for it. I told him then it was a temp situation I would be here for 6 months. My job is over and Im prepared to return home, but in February he filled custody with the courts here. He is single seeking every other weekend, which is fine with me. We had temp orders set and he get day visits gradually increasing to every other weekend. The pass judgment said that my need to relocate will be addressed at permanent instructions in July. As I don't know anyone here, and I have been planning to move home since I get here, I have giving notice at my apartment, and my husband has giving become aware of at his job. Since the judge told me I have to stay within the metro area (which is not my permanent home by any means) what will happen if I move home anyway? He doesn't want full custody, but he may ask for it if I move. Will the courts embezzle away my baby for that? What kind of legal repercussions are at hand? Where I am now and where I want to go are both contained by the same state. They are just 250 miles away and in different counties. I know it's a incredibly legal question I was a moment ago hoping someone had been through it! Thank You all for you thoughts.
Best Answer:
i assume you already have a court order contained by colorado. if this is correct, the colorado court has continuing, exclusive jurisdiction over the child. (with some exceptions) the judge cannot compel you to remain in the state contained by order to keep your child. if there are colorado instructions, there is a serious legal question as to whether the deem in second state had subject-matter jurisdiction over the child to enter any orders. this is a complicated situation and you really should consult a advocate knowledgeable about interstate custody issues.
i would talk to your lawyer about that. if you move away, they might pilfer your daughter. good luckk
Contempt of court sanction including prison; loss of custody.
