2 counts of murder, is this double standards?
I live in Maryland where a man has recently been charged with 2 counts of first degree murder for killing a pregnant woman and her unborn fetus. Though I do not necessarily disagree with this and I feel this scumbag should probably recieve the death penalty, I can't help but question the reasoning of the charges. How can a legal system that allows abortion of an unborn fetus just because the woman chooses not to have a child, apply first degree murder charges on behalf of the same fetus if it is killed by someone else. What do you think and why?
Because this woman CHOSE to have her child and was just days away from delivering her baby girl! She didnt CHOSE for that as shole to kill her and the unborn child.Its a womans choice to get an abortion.It wasnt that womans choice or that poor unborn baby's choice to be killed!

when it comes to judging, it sucs...it would have depended whether the muderer knew about the fetus or not, or whether he intended to kill the fetus or not. then again, in a way, it does not matter, because the murderered brought this upon himself...and he got the whole package
Bush is anti abortion, he's got immense support and the movement is growing stronger under him..so maybe that's bringing about a change in the law as well.
or maybe Bush has an ax to grind...?

I understand your point on the abortion/murder but in this case the child was killed by a crime. The mother didn't make the choice 4 the child 2 b killed. A lot of states if not all only allow abortions up to a certain trimester. While a lot of states find it 2 be murder if a fetus is killed after a certain trimester. If your talking about the 'cutts' case. She was due in 2 weeks it would of been murder even if she tried to abort. Let alone him killing her in return killing the child. I don't think it's double standard because abortion(within legal abortions) is a choice. Where as killing someones fetus isn't. Ppl against abortions will say it's murder either way. So it all comes down to personal beliefs.
There is a very simple reason for this inconsistancy. The pro-lifer managed to get the inconsistancy passed into law. Prior to Roe v. Wade if you killed a pregnant women you were charged with one count of murder.
After Roe v. Wade affirmed the right of privacy, many states passed the laws making it a double murder to kill a pregnant women for the specific purpose of creating the inconsitancy.
This man will face the exact same prison time if he was charged with just the murder of the women (because the sentences will be served concurrently).
The double homicide law does not offend the consitution so it remains on the book even though it serves no purpose other than to create an inconsitancy and give the pro-lifers a rallying point to poke fun of an inconsitancy they created solely to have inconsitancy to poke fun at.
