if it's a felony then no.
Under your scenario, he would probably strike a business if he knew there was adequate evidence to convict and retire as part of the deal. If this is the case, he retains his retirement, however, lower than state law cannot receive pension benefits while incarcerated so no pension benefits (while contained by jail). That's why the deal would be struck, details negotiated and retirement completed BEFORE a conviction is obtained. If convicted while still alive, he could be denied retirement pension/ benefits for a felony conviction.
