Answer:
I know this is a little different scenario but I'll tell you my story anyway. I had a cancer policy through work and wouldn't ya know it? Yep, diagnosed with the big C - in Feb of 2000 at the age of 33. Bummer but cancer free for seven years now! Anyway, the money for this policy was deducted out of my check every payday. I had the paperwork. When I made a claim they denied I even had a policy!!!! I fought them tooth and nail for FIVE years, the money wasn't a lot (a relative term of course). The policy provided for missed wages and what portion of the bills I was left with after my primary paid. After the lawyers cut ( 1/3 ) I took home about $12,500. We never went to court although I WANTED to! And I would still be fighting them if they hadn't finally given in. IT'S THE PRINCIPLE for God's sake!
If you have a case PERSEVERE! But if you're ambulance chasing, be ashamed! (Not saying that YOU are, but there are plenty out there). Good Luck!

many factors, after your bills are paid, the amount of money you will receive depends on many things, the type of injury, your earning ability before the accident versus your earning ability after the accident, then the lawyer will usually take 1/3 of that leaving you with 2/3
