Charged w/ trespassing on land I work at?


I work for a company that leases property w/ 2 lakes on it(gravel pits) I have worked for this company for 7 years. When I started 7 years ago a company owned it that allowed us to fish even built a boat ramp to use my boat within them. My supervisor at the time and I would stay after work and fish often,until he lost his job there 2 years ago. At that same time a different company purchased the park and had to honor the remainder of our lease(8 years I think).During this time of different ownership and a new supervisor we as employees enjoy never been givin any rules regulations or such as to what we can or cannot do on this property.On Memorial Day this past week I took my boat there fishing (I live on ground that is close to this place) and a cop drove back there and said someone call and said I was Trespassing(the new owners),however he was ordered from his tenet director not to issue any citations and I was fine, he left I went on fishing. Now the subsequent day (during my vacation)my supervisor calls me and says I am one let go because I was caught fishing at the lagoon! I told him he knew I fished there and that I was not issued a citation and be not on the clock or violating any contract sections or articles(we are Teamsters) He said it was out of his hand.On Thursday I recieved a copy of the report that said in it The Lt. was not authorized to cite me per his Law Director (City Prosecutor )because there be no "NO TRESPASSING" signs in place. On Friday I get A call proverb They will have to cite me and that I have to meet them nearby on Mon ( tomorrow) to recieve my ticket.If I had been told I could not fish I wouldnt . A guy taking a 30,000 dollar boat and a 30,000 dollar truck to a gravel pit is really in his right mind not trying to sneak within. My Question finally is does this sound right legaly? We was never told we could not fish any more when the new company purchased the topography. I really am not treaspassing I work there just for a different company. Thanks! My contract says nought about anything close to this matter. My Union Rep is aware of this matter and say it is none of my companys buisness what I do on my time as long as Im not violating any company policies, (I am not) He also told me that if I am not put on the schedule that my union will put a bet on me 100% on this and will be looking forward to this grievance something he says he normally does not do.From what I understand this company that owns the park has put a restraing order on me. The police are willing to work w/ me as this company violetes oodles of there ordinances and is not on good jargon with the city I live in. Please? No details left out,I own never been arrested,never been told to stay out I am the Steward of this Plant. I continued fishing because the officer told me I was fine and that nearby was no problem he included that in his statement.We as employees have no idea (till now) that a transaction had taken place or what was surrounded by the lease contract w/ our employer and this other company.As for political,the city from what I understand now has have numerous attempts to get the company to place signs for now trespass as to keep infantile children from playing there however they would not comply and in that instance they would not issue citations.I think my employer could own said look as of such and such date the land was purchased and under spanking new our current lease the company we lease from will allow no trespassing after working hours. Yes I did catch fish I have helped stock this place for the 6 of 8 yrs Dear Stymied, Attitude Like mine? Great, more of our tax money being frivolous on a petty "crime". They should have just given you a warning if it be your first time.
The signs are important. If you were not warned to stay out, next you should be found not guilty at trial. As to your job, I have no idea what your contract say. That is a union problem.
I would fight it. Both the ticket and the wrongful termination. If there are no signs and you have be allowed to boat/fish there for years, you were not trespassing. If the new owners did not want anyone on the lake, they should have had a statement made and presented it to your company to distribute to all of their workers. If you are "Union", then have your union rep cart care of it, isn't that what you pays dues for? Did you catch any fish?
This is what happens when you assume something. A new owner means investigational rules. You should have asked. You may work on the land, but doubtful you work in the lake.
You can be fired for any reason, even if its not reasonable. As for the citation, you almost of course would have good cause to barney it as the law requires no trespassing signs and/or actually being told to sign out.
i'm not a legal expert or anything, but it seem quite silly of the new company to get foolish at you for fishing if they made no rule about it and you could do it with the old company. you should be OK, but i'm no official expert so...
