What are the rules re: Aggressive Creditors?


Ok I had a loan last year for under $1 000, and be payiing it off in regular monthly direct debits of $148, however lost my mission at the end of last year, So contacted the loan company advising that I'd lost my mission and to please put a stop on the direct debit until I'd found a permanent job and could make payments again. However, the company continued direct-debiting my a/c, so I have to put a stop on the payments with my bank in Mar. The company continued to try to d/debit my a/c (but be unsuccessful due to the stop). They contacted me and I explained the situation saying I didn't have the funds in my a/c for them to direct-debit and advise that once I'd found a permanent job I'd contact them to arrange re-payments. Last month I tried to phone the company (but kept getting the engaged signal) so sent an email truism I could start making small payments as I now have a temporary brief but couldn't commit to regular direct-debits (as I'm not sure how long the job will last). However I never heard back from them except for messages departed on my phone asking for pmt, which I then responded to advising my situation each time. So 2 days ago, a Very aggressive guy call from their 'Collections Dept' threatening to "send the sheriff to my house and take possession of my furniture etc as I hadn't made any payments" (BTW I live in Australia, not USA - near are no 'Sheriffs' here). I told him that I'd tried contacting the company with no success, and that I was glowing to start making payments directly into their bank a/c of $100/fortnight if he gave me the company's bank a/c details (As they couldn't debit my a/c any longer due to the stop) and also advise my outstanding balance. He was non-committal to this (after I explained over and over the above circumstances). He denied receiving any emails from me, so I advise that I would re-send the emails sent (which I did). 2 days later, I still hadn't received either the bank a/c details or my outstanding be a foil for from the company, as requested. (So I rang the company and finally got the details and made a pmt today). But why do Creditors behave like this? If they want you to pay packet, why do they make it so difficult? And is it so necessary to be rude, aggressive and make threats when someone's liable to do the right thing?? Also, how do you handle this? As it's quite upsetting. BTW sorry for the long interview!! i feel very sorry 4 u but it seem like they can do what they want 2 do becouse we tolk money from them. but not your stuff unless its in your lone like that u put up your tv, rings ect, we be on are last car payment and it be going to be a half payment but lucky us the bank go under that part of it were are expenditure was going so it went to the creditors yes last costs went up or a payment and more becouse the place we got the money closed and we have to pay. we payed becouse it was almost done one payment it be are car well it was going to be partially payment so if u can sent up some thing i would do it . i don't know why they yell at u but try to work it out suitable luck with it.

I don't know much about Australian law but I do know that they can't seize your furniture or other property in need a court order. It is a BLUFF on their part.
