I need to know MIchigan Divorce Laws.is it 50/50? An Affair was involved,so how can it be'No Fault?
Been together 18 yrs , married 5 yrs& 6 months.Heading to Divorce but I feel like I am in a losin Battle .He never wanted me to work & I have no income & no help from him at all.I lost a baby during 5/2005 so We have no Kids.He pays no form of support( Bills e.t.c)I had to Borrow to pay for the Lawyer( And Bill keeps growing )He had the Affair & tells me ..Michigan is 'NO FAULT' state.He filed in Sept 2005 in Different County from which I live & it seems as if My Lawyer & his are just dragging it out to make more $$ & or m Drain me of my $$ so I will just settle out of Court.I 've been told that I am entitled to support& alimony ? Am I ?And that there is away for him end up paying for my Lawyer. Help :)
I disagree with your first answerer - no fault means the court could care less why you're divorcing but it does mean you're entitled to support. In situations where both people work, regardless of kids, the judge looks at the combined incomes of the two and splits it down the middle and the one making the most money pays the other to make up the difference. In your case, you should go after 1/2 his income and if you're afraid he won't pay, ask your lawyer to set it up so his support is paid directly to you by his employer.
You should also get 1/2 of any asset sales like a house.
I doubt you'll get him to pay for your lawyer, but you can always ask. Also, don't be afraid to go after support you should have paid since day 1 of your split.
Michigan went to No Fault divorce over 25 years ago to simplify divorce. Yes, you can petition the court for an order to make him pay for your divorce and attorney fees. It's unlikely you'd be able to receive support or alimony because there were no children, but you can try, and see if the judge would allow alimony for a specific period of time. Once again, it's not likely to happen, due to property settlement. See what your lawyer has to say.

I am getting married in September and my fiance asked me if I would sign a pre-nup. I research the law and it's a no-fault and it's not community either (like CA) so basically it's sad. I would see if you can get your lawyer to have your husband pay for your education. So you can go back to school and get a degree and pick up the pieces.
