A way to get out of drunk driving?

I was told that people have done this to bring back out of drunk driving. If they know they have been driving drunk and get pulled over while doing so, they hop out of their vechile, verbs out a closed bottle (a closed bottle is legal to have inside a vehicle, but a open bottle is dishonest in most states) open the bottle infront of the officer to prove that it was closed to commence with, and drink several gulps of the liquor. Then they say "I was so shy I had to take a drink." If this is done then the officer can not prove you be driving drunk. The officer can not give the person a breathilizer because he saw you drink infront of him and cannot prove you were drinking previously to that. I be told that you cannot be arrested for drunk driving.

Not that I want to do this, but I was wondering if anyone has heard of this really working and if youre an officer what you would do if a human being did this after you pulled them over.
anyone who does that is just asking to grasp the smarta$$ award in court

what is the smarta$$ award? it's getting charged with EVERYTHING they can think of and screw you over as hard as possible to teach you a lesson

and besides, in my jurisdiction the cop would in recent times lock you up in the squad car for 15 mins, then afford you a breath test and call it a day...you'd be going down for drunk driving AND you would be giving yourself a better BAL

Ridiculous. Do you think the officer, if he is close enough to you to see that you open an unopened bottle that he/she is simply going to stand there and watch you drink it?

What you would end up doing is simply have a higher ETOH on the breathalizer.
They would still find some crime to charge you with. They will experiment you for alcohol in your blood.
That sounds like something only a drunk would come up with. Even if it did technically "work," the officer could - and would - charge the personage with unsafe driving and anything else he could throw at him. lmao, no that doesn't work, and drunk driving kills don't do it.
they test your alcohol smooth and that would prove you had been drinking beforehand.
Here is an article that discusses some of the common myths about OWI arrests. The myth you mention above is totally false. In fact, if a personality did that it is strong circumstantial evidence that the person is intoxicated. You may even get an additional charge of obstruct an officer.
