sick of immature brother. small claims court?


my OLDER brother (he is 20 btw) is the most immature and careless person i ever met. I sick of him treating my property and me similar to crap. He has never had a single job and hasnt done anything to try and win one. He is rude to everyone in this house and has pretty much lost the respect of all his friends because of his behavior. He just this minute took all the groceries out of the fridge and jumped on them because mom wouldnt give him a few dollars. and conversation to him doesnt work because he just breaks more stuff now my mom wont do anything about it. He have stolen various games and cd's from me he pawned off my x-box inside a week of me being away to college. I no longer let him use my laptop because he mistreats my stuff. he recently back up into my car. and he has threatened to break my laptop for me not letting him use it. Which he probably will. he has arrested several time and any more screw ups and he is sent away for a long time. he purely continues to treat the stuff that I PAID for like crap. But now that I am past the rant(which I am sorry for) what steps are needed to be taken for sueing him within a small claims court for breaking my laptop if he were to do so or if he damages my car again in any other method or just anything of the sorts. oh im 18 btw in case you be wondering.

i would take him to court, but the only problem is, without a opening your not going to get anything out of him. and not even teach him a lesson. Since your parents are condoning the behavior, i would ask them to replace you items. here's what you do. Everything of value you own, help yourself to it with you when you leave the house. Your laptop, game system, anything you don't want destroyed. annoying, yes, will it keep your stuff safe, sure.
yeah small claims court. File it, see what happens.... He doesnt show up - judgment in your favor - stuff out the paperwork to garnish his wages He shows up and you win - same as above He shows up and you lose - self help, and cut him off from your vivacity.
Ok, the first thing you need to do is get away from this creature. He is obviously not someone you can be around and keep cool. I mean, I would own bashed his skull it, so kudos on not being in court for murder. You own more patience than I would. Second thing you need to do is contact your police department and detail them about all the things he's done. They will tell you whether you can charge him or not (You can) and later direct you to steps that need to be taken with his arrest and prosecution. Or you could just slay him. That's easier.
