Can a credit card company take out money from a checking account without the account holders permission?/?
This has recently happened to me and I need to know what my legal rights are. Can anyone help me and provide some sites I can look at?
I seriously doubt it. If you've kept your credit card carrier's terms and conditions pamphlet, read through it. If not, call customer service, file a complaint, and contact the Better Busines Bureau. Hope this helps!

Taking money without your permission is theft. You should be talking to the police and/or your District Attorney.

Contact your State Attorney General. He will have a website.
They couldn't do this unless you defaulted and then they went to court and obtained a judgement against you and then got permission to attach your checking account.
The other way that would do this is if you made arrangements with one of their collections people giving them permission to draft your account each month for a minimum payment.
If you gave them your checking account information and they have a document you agreed to or signed stating that they can take the money then the answer is yes.
If you were sued by the company and they are levying your account then yes.
So many reasons why this happens. Now if you can go through a process to stop them, you might have a case. However, they would win and you'd have to pay everything you owed because you still owe them legally.
Depends on if you are overdrafted or what the charge is for.
If you have signed up for auto pay, or have sign the contract that allows them to do that then your S.O. L. If you are up to date then that's it. BUT!!! If you are behind in payments and the company gets a court garnishment approval then again your S.O.L.
Not unless you've agreed to 'automatic' withdraws.
