Suspended license problem?
This is really complicated. To start things off, back in January 2007 (I be 18) I hit some black ice on the highway and was t-boned by a truck. Now, the car I be driving was owned by my father and I was under the assumption that I be insured. Well, 8-9 months later (Sept/Oct of 2007) I am sent a letter saying that I wasn't insured and that I owe $10,000+ to the character I hit and my license would be suspended until I paid it. Seeing as I was unaware that I be not insured, my father said he would take care of it.
Recently I was pulled over by a cop, handcuff, and thrown into the back of their car because my license is still suspended (unbeknownst to me.) My father hadn't done anything to remedy the situation and the $10k+ is over my head, not his.
Is near any way for me to take him to court and get the debt (and suspended license) within his name? He would support me saying that I was uninformed of my not being insured and that he hadn't taken care of my suspended license.
It was not your father's responsibility to take care of your suspended license, it be yours.
Some policies cover drivers in a covered automobile, some don't. Check with your insurance company to be sure. However, in this valise it was your father's responsibility to know the terms of his insurance, and he was the one who give you permission to drive.
read and reread the insurance contract. most insurance covers anybody you let drive your car. if this is not applicable to your dads insurance you are up a river short a paddle to put it nicely. you cannot have it put contained by his name or even do anything that will make him responsible for the bill. its on you. My aunt is a judge and agree to me tell you something about them...they have no sympathy. Mostlikely if you move about to court the judge will tell you that you shoud've been aware beneath what conditions the insurance car you were driving was underneath. So you not knowing that you weren't insured isn't going to matter to the judge & instead you might end up getting a talk from him/her.
About your dad paying the money, the judge won't care about that unless you guys made a allowed contract where your dad is saying he's responsible for the money owed & that he was going to compensate it.
You might want to do some more research, but sadly I think you're going to have to payment that amount owed to the other drive.

Once you reach the age of 18, it is your responsibility, and yours alone, to make sure you own a valid license, are driving a car that is registered and insured, and pay any debts you incur for any common sense. Your father can offer to do something for you, but he is under no legal constraint to do so. You are an adult, start taking responsibility for yourself. Taking your father to court? Bottomline.... it will not fly in a million years. I assume you want an honest answer.
In regard to the driving on suspended the pass judgment won't care. You were suspended.... and you owe. You were driving. Even if your father have paid the money YOU would have to take this proof to DMV or whatnot and find reinstated.
The other people that the money is owed to? They don't care either. You be driving. Because you and your father made assumptions there will be no defence. Maybe if this had be attended to earlier you might have been competent to fight the 10k. But since it has been so long contained by the end you just owe it.
Best case scenario is your father pays it and you are competent to go to court with a renewed license and clear it up.
Otherwise you will have to concordat with the suspended, pay the fines, owe 10k, maybe capture your wages garnished and watch your insurance go up.
