If a teacher finds out that a student is injuring themself does she have any legal right to tell the parents?
Just for specific clarification the stundent is 14, both birth parents are legal guardians. The student has been adjectives OCCASIONALLY for the past year. The teacher knows for sure, and have spoken with the student about it. The student has made it especially clear that she does not want her parents to know. There are no indications of suicide or homocidal attempts, or expression of suicidal or homocidal thoughts. There is no record of the student becoming violent, and no record of any psychological condition bar mild-moderate depression. The stundent lives in Georgia if the law (if even in existence) vary with the state. Also just to clarify I don't want any advice on whether or not the mentor SHOULD tell the parents, just if they CAN. Thank you for your time.
You can contact them yourself, or if you feel more comfortable, you can speak to your school's counselor and have him or her speak to the student and afterwards get in touch with the parents. Either path, the parents need to be informed, legally. Could, should and MUST
whether legally, at hand are moral issues that transcends legal
The trainer is required by law to report it. I dont know of any law stating the teacher can't relay the parents, unless the teacher signed a confidentiality statement or something...
yeah you're allowed to tell anyone you want anything whereever you are I'm Pretty Sure the lecturer has a right to tell the parents.
i am pretty sure that a teacher is required by law to notify the police and child services if a student is hurting themself. I don't know if she have the right to tell the parents, but she has a legal responsibility to report what she have learned to her superiors, and the issue should probably be handled by a guidance counselor.
ummm no.it's none of your bussines have her address to a counsler u don't know enough and social workers=counslers are trained to deal with this kinda stuff not you
The only duty where you CANT tell anyone anything is a doctor and they take an oath. Now, im not a tutor but I'm pretty sure my sister didn't have to take an oath. And if its harmfull to his health the professor should tell his parents, just give them a obedient explanation to how they found out.
Oh and its a legal obligation! i would make the child see the college councellor. maybe the childis cutting thesleves because of problems at home.
You don't know wether or not the parents are abusing the kid, or what ever the problem may be. If you told the parents that could purely make them angrier at the kid and make matters worse. Send the kid to the councellor and tolerate them find out what is casuing them to cut themselves.
If the student's life or health is surrounded by jeopardy, then the teacher has the professional responsibility to report to the parents, or a doctor if necessary.
If it's just minor stuff that isn't putting the student's health at risk, after it's considered confidential. However, cutting is normally considered quite serious.
You are a student and a minor. Not with the sole purpose does she have the right to inform your parents she is morally obligated. yep just like any other authority integer.
Yeah, they are required by law to tell the student's legally recognized guardian(s). Ask a counselor, Anything involving them hurting themselves, or someone else is required by law to be reported. Teachers are required by law to report suspected abuse, and teacher cannot be sued if they make a call with accurate intentions and it turns out the guardian did not abuse the child. In the case of self mutilation (cutting), a teacher may not be required to beckon a guardian, but teachers also sign an affidavit of moral character, which means one a fine, upstanding citizen, they should notify either the parent or a school counselor. Cutting may be a sign of something else being wrong surrounded by the child's life, or the child may be in need of oblige. As a teacher, I would tell the counselor and let her know the student's wishes, and agree to him/her make the call to the guardians.
In the state I live within, it is the law, that if a teacher finds out that a student is being harmed surrounded by any way, they must bring it to the attention of the proper authorities.
I have a daughter that was a "cutter" and once we found out and get her in to therapy, we found that it was a moment ago the tip of the iceberg as far as her problems went.
I believe that if someone is cutting themselves, that would fall underneath the category "being harmed or abused in any way."
You call for to look in to your state law but I think that if you are wanting to report it but hold been sworn to secrecy by the student and don't want to loose the trust of other students, then you can find a method to use the law to report it, if you try.
There is a legal obligation for the teacher to report this. SHe doesnt own to tell the parents, but she has to tell the police. The police can evaluate if in attendance is no threat of suicide, etc. I would at least tell the district psychologist. That way, you arent breaking the regulation, and you save face with the student. A don has a moral and legal obligation to report any injury of his/her students rapidly. Otherwise the district can be held responsible. The source of the injury doesn't matter. Where it took place doesn't matter. Period. (I'm a former teacher.)
I believe that a teacher is indebted to report such incidences. I am sorry but I don't know the legal side. I feel that the teacher have a responsibility to the student to let someone know other than the teacher and tolerate the people who know the law and are trained in something resembling this to take the reigns. The teacher doesn't have to get hold of any more involved than letting the proper person know.
They not only can, they hold a legal obligation to do so.
They are child advocates.
Just as they must reasonably report parental abuse, they must inform on a child hurting themselves.
Additionally, would they not be putting themselves at great risk for a law suit if something happens and they parents find out the guru knew? Teachers in this country can never catch a break.
A instructor is a mandated reporter. By law he/she must report any abuse even self inflicted. Hmm i'm not sure if truth be told. Any teacher would know the rules though. Ask a teacher :)
teacher should tell your parents Teachers are legally obligated to report any signs of name-calling. They can be sued and held libel for ignoring any signs of abuse or neglect including sef-abuse or ill-treat from parent. friends, guardians, etc. Teachers are trained in reconizing the signs of abuse and where and how to report it.(In my state anyway)
