Now theres the new smoking law, is it ilegal to smoke around your own children in your own home?

I have heard that they are trying to pass that in some areas. I do know in some custody battles, and when the state gets involved, they can and do add that to a court order, that there is to be no smoking in the home, car, or in close proximity to the child. I think this is good. Why would you want your child exposed to 2ed hand smoke. It is a persons own freedom to harm their own health, but not that of any child.
Only in a few condo's in CA: and that's because of common areas not children .....so far
not illegal, just wrong
not as far as i know...however you should really have the common sense not to anyway
Not yet. How could they enforce it anyway?
at this rate soon it will be illegal to do anyrthing
It is not illegal to smoke in your own home, but anyone with a modicum of common sense knows the danger of passive smoking, so why inflict it on your children?
And they thought socialism was dead.....

The government doesn't need to be telling us what we can and can't do in this matter.

There is no factual proof that second hand smoke is harmful. To the contrary, the single study on the matter showed that there was almost no risk. That wasn't how the media played it.

The most used study to 'prove' the dangers of smoking was debunked nearly a decade ago. It shows just how stupid people really are that they still believe it.

Most adults smoked until around 25 years ago. The lung cancer rates are actually higher NOW with fewer people smoking than back then. It's something else people, time to move on.
I personally feel it should be considered child abuse. Why would you want to smoke around your children if you know what the facts say about second-hand smoke--IT KILLS--that is no joke. You should value your children's lives more than taking a puff.
that's stupid, as if they can stop people from doing that in their own homes! impossible to keep track of it! like people are going to abide, i think not! unless big brother really is watching then you cant stop what you don't no!
All I can tell you is that lawyers are out of control, lawyers have put controls on everybody and everything put themselves. I think it is time the people take back the world from the lawyers. ...... Oh don't say the Bar Association, that is just a good'o'boy club for lawyers to get together and laugh about how they screwed some client.
No it's not illegal but it's highly undesirable. If you are any sort of parent at all you wouldn't be asking this question, you would be saying 'how do I stop people smoking around my kids'. As a parent you should be among the first people to give up.Don't you care what happens to the children's health in 20/30 years.
Murder has allways been illegal.
it should be
people who smoke around their children obviously do not love them
No but it should be illegal to smoke around children!
In reply to Answer Lady's answer:

Firstly, the ban on smoking has nothing to do with socialism. Socialists have no general opinion on this matter; you will find nothing on smoking in any of Marx or Engels' books. If you mean general control, you are misinformed about what socialism means, and I would advise you to read the Communist Manifesto.

It is true that there is some evidence that suggests smoking and second hand smoke are harmful, but only because the research was funded by companies related to Tobacco. It would make no sense for the government to ban smoking unless it was harmful. (Which it is.) Since we live in capitalism, the only real motives are profit, and the government would not profit from doing this. In fact, they would lose any support they might have from the Tobacco industry.

Finally, there are other factors in lung cancer, but we can not ignore the dangers of smoking just because of this! Perhaps it is harmless (although I do not believe this). But until we are sure of it, we should trust what evidence we have otherwise, and protect people.
Why would you smoke around your kids?
I smoke, but I have no children. I also do not drive, so don't prejudice my health by driving your car down my street. Combustion of petrol releases the same carcinogens as are alleged to be released in 'second-hand ' tobacco smoke. I am therefore a passive driver.

By gum, if any government has the guts to acknowledge this fact, I'll sue. By heck, I'll sue, and sue, and sue. Exxon, BP, Standard Oil, watch out. Foghorn is on the warpath.

People who regularly view my posts will, perhaps, recognise me as a very liberal guy as regards freedom of expression, whether one is left or right wing, Muslim, Christian, Pagan, Agnostic or Zoroastrian. I am, however, hacked off to the gills and beyond with smokers being branded as virtual murderers. I have to inhale particulate matter from diesel engines both outside and inside my home - these particles are carcinogenic. I'm sick of secondhand noise, secondhand petrol fumes, secondhand barbecues (I have to keep my bedroom window closed in summer - BBQs trigger my asthma).

When I worked in London, I used to cough up black phlegm and I had to use my inhaler twice-daily. I now work in a little coastal town with little traffic, and my doctor has downgraded my inhaler to the mildest one available. My doc puts the black phlegm and inhaler use down to diesel fumes. Obviously, he would prefer me to give up my pipe - he is constrained to do so by the ethics of his profession, but he admits that the effects of inhalation of petrol and diesel fumes on the general public are under-researched.

Furthermore, I have to search people as part of my employment. I have kept a private record of people carrying inhalers, and, so far, after a year of research, I'd say that one in fifteen people carry an asthma inhaler. Asthma increases, yet smoking decreases, and the places in which one can smoke are virtually nil. Are we carrying genes from our parents generation when smoking was universal that is creating asthma or COPD in their offspring? Or is their some other explanation?

I am hacked off with people who say that smokers are virtual murderers. May your pleasures turn to ash, may your freedoms be restricted and your protests be stonewalled by the politically correct generation that you have laboured so hard to create. May you reap the fruits of your own intolerance, and the lot on you.

Answer:
It's not illegal in the UK, but it is unethical.

I was in a cafe the other day and two people were smoking around my nine month pregnant sister and a woman who was breastfeeding.

Some smokers are so ignorant and inconsiderate.
