Neighbor's roommate smokes pot every night, and it leaks into my house. How should I handle it?

I live in a suburb of San Francisco on the peninsula, where houses are pretty close together. This guy smokes pot pretty much every night and it comes into my bedroom. Houses don't enjoy air conditioning in this area, so I usually hold a patio door open at night to preserve things cool. This stuff is strong, nasty, skunky, and I don't feel as if I should have to put up beside this. It lingers in the house for a long time too. I already spoke with the owner of that house, and he said he'd enjoy a talk to him. A couple days later, the smoke was so cumbersome, My daughter and I woke up at 4:30 coughing. I was fed up and called the San Mateo police department. Even though it's crooked, they said they can't do anything about it if they are in the house. They did a driveby and the next morning when I call to see what happened, they said the officer didn't smell anything so he drove off. The smell/smoke drifts into the back patio only. I don't know what to do! The smell is atrocious, but I'm getting ready to work with the FAA, and I'm afraid I'll pop on the piss experiment. Any suggestions? Thanks for the suggestions so far. The owner of the house knows about his drug use. That guy has lived within for 15 years, was arrested once, and the owner found a gun under his bed while he was gone. This is so frustrating because neither the owner nor the cops appear to care. My husband is deployed so I'm not going over there by myself if that guy is armed. I know pot smokers are supposed to be chill, but he obviously have a record.

I work out your frustration.(Take someone with you or ask a male neighbor if you have one) I would depending on your neighbors self-esteem ask them nicely to try to contain it to there home and that you and your daughter smell it at night and that it bothers you, and not merely that its not good for your child and explain thats it could spike Esma and your job situation. Maybe take a peace offering of brownies or some sympathetic of munchies. Let them know you don't agree with what they do but its ok that its there choice, and you choose not to do it but respect others around them and maybe right to be heard you heard other neighbors talking about contacting the police and have someone watch there house or that they know someone in the DEA that you'd despise for something bad to happen to them or ruin there futures even though you probably reason they don't have one. I am pretty sure that they will get paranoid and tone it down. If there rude infantile punks try it but normally you might have to take a different approach conceivably go to the police and ask if they have a police officer that you can personally telephone in this situation or even an under cover in the nouns that you should call. Use your instincts and judge of character some society in this world you never expect to be crazy or dangerous. In other words don't put your self in exposure. After all I don't think second hand smoke would hurt you too much. If the police maintain letting it go either they know him personally or they are watching him to find further details and don't want to jeopardize there investigation. He just might be a big dealer or someone that give them tips on other dealers to stay out of trouble.
You can speak to that guy and request him not to spoke at night times surrounded by home. No other way you could ever get this task done. So its clever to speak to the guy and resolve the issue rather than doing it legally which won't be of much help. Speak to him and convey him that you are surrounded by trouble because of the smoke. He would accept it.
The smell of weed is very gross and it is really annoying the police officers should amble into your backyard and take a whiff if they smell it they can do something about it unluckily police officers are usually to lazy and have "better" things to do consequently solve simple problems like this Oh and if the actual smoke gets into your house and gets trapt it is possible to grasp a small contact high [a high that happens purely from being around the smoke] which will apear on a drug screening
Ask your neighbor to keep his window closed when he smokes. It really doesn't have need of to be any more complicated than that. You could also buy him a nice smokeless ashtray for $5 as a belated house-warming gift.
If you want to go the legal route, and the cops won't address the situation, depending on the law in your state you could have a valid civil action. The smoke could be considered a annoying person that interferes with your right to enjoy your property. In addition, what you are describing is credible a continuous nuisance because it is recurring or ongoing. You have notify the owner and the perpetrator has been put on notice, so it would be likely to sue both of them in a single lawsuit. If you want to ask for minimal damages, less than $15,000.00, you could file it surrounded by your lowest level court, in Georgia we refer to it as Magistrate Court. You don't have to own a lawyer. Often people are a lot more responsive to civil suits and it may solve your problem. Just be sure to receive copies of any reports you have made to the police and communicate with the neighbor and the owner of the property in writing so you enjoy a papertrail. If after you try dealing with it in writing, particularly informing them that you will hold to file a civil suit if the problem is not solved, file suit.
Just buy an air conditioner, and close the patio door. Either this is a damn moral neighborhood for you to leave the door open, or you like keeping up $hit. Good Luck:)
find his lanlord and say something. other than that theres not much you can do except move about to the guy yourself but i doubt he will stop. maybe the lanlord will make a surprise visit and smell it and see the guy out. good luck and drink lots of water just within case to filter out your system.
Take the owner of the house to court and request that the person be evicted for drug use. It's creating a health risk for you after all. You may be able to get an writ of protection against the guy as well.
