is it legal for a collections agency to garnish your wages from your employer?


There has to be a court order given to your employer to garnish your wages. If this is a problem you should go to a credit counselor and get them to help you do things another way so you don't lose your job.

I don't think so, not unless they take you to court and sue you. Also, depends on where you are. Different states have different laws.
The only way a collection agency - or any organization for that matter - can garnish your wages is to petition the courts for the money. When a collection agency feels the only way they can obtain money from the debtor is to take legal action, you are notified of the court proceedings. If you don't answer or try to fight these proceedings then a judgment is entered in favor of the agency and that judgment is placed on your credit report under public records. If the agency wishes to enforce the judgment then they have every legal right to garnish your wages, but again this is a court action and you get notification of such proceedings. If you feel that you can resolve it without them garnishing then you should take such action because as with the judgment, all garnishments are also placed on your credit report. Collection agencies are not allowed to threaten or coerce a debtor into paying their owed moneys because it is against the 'Fair Debt Collections Act' and the collector who does this is fined individually and depending on the extent of what they did, it could also mean that the agency itself will be fined along with the collector.

an agency wont really go that far. some have legal depts and most threaten they do but dont. if one says they will do taht then ask to talk to the legal dept then when the person answers ask for their name and extension...I guarantee it wont be legal. they'll give an alias...theyll talk bs but nothing is real.

In order to garnish wages you need a court order. they must prove you owe the debt and serve you with documents. if they havent done that....no worries.

It is and if your employer doesn't want to do it, they can fire you.
