Has anybody received compensation from the council for damaging their car while driving over a pot hole? How?
Managed to find a rather large pot hole the other day which burst my tyre. Had to obtain a new one and have odd sized tyres so it cost me lb105.
Clear bright afternoon, no rain etc, but a car coming one way and a ditch the other side. National speed ceiling, so no chance of missing it or stopping but did slow down. Burst my tyre anyway.
Is there anyway of claiming some, if not adjectives of the money back, on account of me paying road tax?
If it was within a construction zone, you may get them to file a claim for you. But you can't beat city passageway, unless you sustained personal injury.
Document the hole (cell phone camera), get an eye witness, get the tire repaired and keep the detailed account.
You may have to use your auto insurance policy, but it probably won't even cover your deductable.

Simple this one! Write to the Local Authority's insurance section near a letter of claim. Set out the details of the incident, date and place and details of the loss. Enclose a copy of invoice. Say that they have been forgetful in that they failed to complete the necessary repairs and as a consequence you enjoy suffered financial loss.
Your letter will then be passed onto the Council's insurance providers and hopefully you will get a foot out.
Ideally if you are able to return to the scene take a photograph and measurements of the pot hole for evidence do it!

The council enjoy a duty to inspect the roads every three months. If they do the inspection and the pothole arises in between inspections they are not normally liable. If they fail to do the inspections or they are told just about the potholes and fail to remove them then they are liable as this become negligence.
Council road inspections are public documents. You should firstly contact your local highways bureau and ask for these details. You could also contact your local newspaper and see if they will run a story to establish how long the pothole has been at hand and when the council knew about it.
Some councils will pay up simply to make you go away so being a annoying person can get you results sometimes. If they say we are not liable when you put in your claim maintain pestering and asking for further information etc and you may get somewhere.
Ultimately if you cannot reach an agreement with the council next you would have to go through the small claims procedure at your local county court. It would cost you lb30 to issue proceedings for a case close to this but the burden of proof would be on you - you would have to have evidence to show that the council either poor to inspect the road or that they knew about the pothole but didn't fix it.
Yes, first you have to find out who is responsible for maintaining the road where on earth it happened. YOu need to contact that government agency. If you have need of to know how to deal with that agency, you can find it in the Official Code of your state, beneath the Administrative Proceedures Act. Whenever you deal with the executive branch of government, the Admisistrative Proceedures Act, take effect. yes i have....i burst my tyre down a lane in Hertfordshire where i live....& bringing up the rear me...another 5 cars burst their tyres too...so i had witnesses!
i put in a claim to Hertordshire County Council...& they coughed up the whole bill - mind you...this be about 6-7 years ago...so don't know if the policies have changed.
