When does accusations of child abuse become harassment?

recently, i took my son the ER for a minor head injury (he is only 2.5 months old, so i was worried). immediately after arriving they thought it was domestic or child abuse even though both me and my child have no signs of abuse. they didnt do anything about my son's head injury (which the pediatrition through was wrong), yet kept me at the ER for 3 hours questioning me (my story never changed, no was it suspicious), calling the police in the town we live in, and calling CPS. i understand that measures have to be taken when dealing with injured children, but i feel like i was harassed. they accused my husband of abusing both me and the child despite us constantly stating otherwise. i want to know if this kind of treatment is normal, and what parents who are falsely accused of abuse can do to fight back and stand up for ourselves. i already filed a complaint at the hospital and am switching. i feel that i was judged because i am a younger mother and in a interracial marriage.
See if you can find a lawyer to give you a consultation. You may have a case with the interracial marriage.

File as many complaints about the hospital as you can - if they failed to treat your son and he did need treatment, they broke the law.

The kind of treatment you endured may be 'normal' in some areas, it is not right, nor is it lawful. Stand up for yourself, you do deserve to be treated better.
IT sucks.....I have had people accuse me bacause my two year old had bruises on his legs......CPS came to my house ask a bunch of questions....People who don't have kids just don't realize that kids get hurt.....the are LEARNING to walk which mean they fall down....the get in the dirt on the hands and knees which sometimes mean bruises on the knees.....the fall and bumb their heads get stiches and even may break a bone or two....it all part of growing up.....the only thing you really can do you have done....file the complaint and move on.....to me its not worth the time and trouble....if you really want to push the issue I would go straight to a lawyer simply because thats what they will do..

Answer:
I would not take this personally. Any child that is not mobile that shows up in the ER with any serious injury, especially a head injury is going to be referred to CPS. The hospital has to by law in order to cover themselves. Basically you went through an investigation. If you left the hospital with your child than obviously CPS did not find any evidence of abuse and closed down the case. Statistics show that children are harmed more by their parents than anyone else, especially young parents. Does this make you a bad person, no, but of course it is a red flag. Race has nothing to do with it.

If you are still upset, think about the next child that comes in with a head injury that was not accidental and remember that this child may be safer because CPS is called. It is CPS's responsibility to investigate abuse not the hospital's. They just have to report.
i think any time there is an accusation that just isn't true, the accusation can be way worse than what may or may not have happened.

Get the facts, be sure, then cal the cops, the a fair trial, then if the judge and jury say so, then jail
No you were judged because you brought a child who is incapable of self locomotion into an ER with a head injury. That is what you were judged on.
Don't toss out the race card or age - you have a child with a head injury at 2.5 months - he sure as hell didn't get it skateboarding, and that in and of it's self is a suspicious injury.
If I was you I would let it drop...the age of your child and the injury suggest that something went wrong and it wasn't the child's own doing.......even if it was accidental..this child received an injury by another .....and this needed to be checked into.... from now on be more careful with your baby.....accidentally dropping a child this age could kill them.....forget using age and race as an excuse for this incident... its not relevant..any person that carries a baby less than three months old into an emergency room with a head injury will be check out..because this is not normal.......your child was harmed ..the hospital did the right thing by questioning this incident...just feel lucky that they didn't find you in fault and take custody of your child....
