What happens to a person when they are contempt of court in Louisiana?
My ex refuses to let me claim my son for tax returns even tho its court directive that I can, she claims him. I pay childsupport and I am NOT backed up in my support. Will she own to pay a fine or slap on the wrist for this?
If you have a court order allowing you to claim your son on your tax-return, next you should go ahead and do this. If she is doing it as well, then markedly she is breaking the Federal law by obvious lying. She is claiming something she is not entitled to. The probability of her getting caught are rather slim. However if both of you are using your child's social security number on the tax-returns, it may not take outstandingly long before the bells go off at the IRS. At this time, both of you are predictable to be brought in to the local IRS offices and show proof. In your case, you are covered because of the court proclaim. In her case, however, it could turn out to be a different matter. Obviously she has nought to back up her claim. So she is in trouble with the IRS. If they preference, they can press charges, or they can ask her to correct her mistake and re-do her tax returns, pay a small penalty and promise never to do it again. Initially, yes, I infer it may just be a slap on the wrist, but if she continues to do this again next years, IRS may not show much mercy. In fact, even you can sue her too for dragging you surrounded by to this mess through no fault of yours.
If it's a court order then claim him. Recently a woman be jailed 90 days for contempt for failing to return a child after a court ordered visit, actually she got 2 consecutive 90 daylight sentences. Are you paying your child support by cheque? Note on each stub that it's support,
Contempt of court though is a ruling made by a judge it's not up to you to determine whether or not she actually is surrounded by contempt. Even if you can't afford a lawyer I would contact the court where the decision be made and ask for advice.
