A 16 year old boy got in a fight with his cousin. 10 YEARS IN JAIL?

A friend of mine has a 16 year old son and an 18 year old son. The two brothers got in a fight with their cousin over a girl, in which the cousin called the police and said they started the fight with him (no one was hurt at all), and the two brothers were put in jail. The cousin then called news stations to tell everyone about the boys, etc, etc.

NO ONE WAS HURT, I repeat.

The 16 (now 17) year old boy got 8 years in prison. The 18 year old boy got 10 years in prison. And the 18 year old boy was the one trying to stop the fight!

The two boys have no criminal background whatsoever and the only thing I can think of for this is that they are Mexican.

Hire lawyer. Who pressed charges? The cousin? Sounds like a lot of time if no one was hurt.

Okay ... there is a lot you're leaving out. What exactly is it these two boys were charged and convicted of? Because from what you're saying this whole situation is impossible (there's no way this could realistically happen -- there is too much judicial oversight). Simple battery or assault (which is what you're describing in your post) carries a maximum sentence of one year in prison -- a judge cannot incarcerate someone for longer than that. This is beyond the fact the 16 year old, as a juvenile, cannot be held past his 18th birthday unless he was a convicted of a class 1 felony (murder, assault with a deadly weapon (with intent to cause serious bodily injury), gross mayhem, etc ...).

I think either you have gotten your facts horribly wrong, or you are otherwise not giving us the full information because what you are describing is IMPOSSIBLE from a legal standpoint.
never in my life have i heard of a 16 year old juvenile getting 8 years for assault with no bodily injury.. something else is going on here. you should contact the courthouse or an attorney.

that is wrong! just plain wrong! and if they are mexican and put into jail, i say racism! this family should take this case to courrt and sue! the police and the cousin! sue i say!~ if no one was hurt, then why are they in jail!? if words were exchanged, the first amendment; freedom of speech!~ There was no wrong doing!~

You are leaving out perhaps the most important piece of information of all: where did this take place?

I can understand that based on the premise of the information you gave that the punishment for these boys does not fit the crime, if there was a crime. However, just in the definition of the crime can lead you to why these boys got that many years for such a midemeanor act (at most). It is due more likely to the location in which they performed that certain act.

To clarify, certain states have laws such as California with the three strikes law. This law basically states that if a person commits three crimes, regardless of the severity of the third crime, they get 25 years to life in jail. Meaning that if you shoplifted and earned your third strike, you basically lifted 25 years in jail for a 20$ shirt. Unfair? Yes, but it is determined by the location.
