do i have to take a dna test by law or can i refuse it?
Why would you want to refuse it? If it is for paternity, wouldn't you want to know if you have a child or not? If it is for a crime I would assume it wouldn't look to good if you are running from it and may show guilt.
They do have to serve you if they want to look into a jail sentence... for you not cooperating.
i hope not. the applied consent law already pisses me off and i think violates my 5th amendment rights

I assume the court order is signed by a judge. If it is, then it is like a search warrant. Yes, there are search warrants for things inside people's bodies (think drugs or blood.)
The police are now even issuing arrest warrants on DNA samples. If the police have a murder or rape suspect that they don't know the name of, they can issue a search warrant if they have the suspect's DNA profile. This is usually done when the statute of limitations is nearing and they don' want to go without filing charges.
Depends on what it's for. I think if it's for a crime and you don't deliver, then they can throw you in jail for messing with an investigation. But if it's for anything else, I'm not sure. Best thing to do is talk to a lawyer and see what he says.
