Can an employer fire me after I have used up my FMLA leave and still need more time off for medical reasons?

I have complications 8 weeks before delivery. This is part of my FMLA leave. I am hospitalized currently and will remain here until delivery. My baby will be kept for an additional several weeks. By then Iwill have used all of my time. Can they fire me?

Yes, legally an employer does not have to hold a job for more than 3 months....they can hire someone else after 3 months, and they are not obligated to put your back to work after that period of time.
If you and your hubby/significant other both work for the same Employer you might be able to use his FMLA leave to cover it. You could also ask for leave donations, but the Employer has done all that they are required to do by Law.
The law requires them to hold your job for 3 months under FMLA. However, many companies also have a maternity leave policy in addition to FMLA. If that is the case with your place, they have to hold your job for however long their own policy allows. For example, my former employer allowed for only a maximum of 8 weeks paid medical leave, but a max of 6 months maternity leave. If that is your situation then you should be fine so long as you come back in time. Good luck.
