Can i avoid jail time?
ok basically i had to goto court and plead guilty for not paying my child support. i was sentanced to 30 days surrounded by jail. the judge said if i can make EVERY sum on time for 90 days he would lift the 30 day sentance. powerfully i couldnt make every payment on time. (i have the money by the end of the 90 days to pay in full but be told thats not good enough, it had to be on the dot, thats what child support office people told me)
when the court date came to see if i salaried it i did something stupid... i didnt show up. i was scared about going to top-security prison. REALLY a bad time for me. i know things will probably get worse from here but im going through a divorce, its almost impossible to find a job around here etc etc. so presently i get a failure to appear on top of that. what are my possible choices at this point?
by the mode i live in the state of tennessee if that makes any difference. Thanks
economically i used to live in tennessee so i know the law a little bit so if you be scheduled another court date then go to it and update them a good reason why you couldn't make it and that you have the payment in full but the child support office wouldnot filch it then the judge might tell you to clear the money in full and you should be ok but on the other hand if you failed to appear later he can give you another 30 days and have a warrant for your arrest so if they have one out you should probably consider about turning yourself in so the judge may be for a moment more leanient. I feel for you bro. You have a bench warrant mostlikely. I would go into court and plee this entry down to being admonished and mabey a fine . I would then reassure the style guru that you will pay on time. Bring a payment next to you to show the judge that you will pay on time. If they still put you within jail then you must live in California! Good Luck
Either tough it out and go contained by or make up with your wife. If you did that here in Pa. your going to send down and probably for 90 days. That was the absolute worse thing you coulda done. Now, I'm sure in that is a warrant for your arrest...I'd find out for sure and turn myself in...it would be the best move at this point. When you get in front of the sort out be polite, explain you had the money and what you were told, be honest about self afraid. Good Luck.
Oh - my younger days I spent time in a few county jails..they aint that bad.
You need to contact an attorney. You can find one that isn't that expensive that can help out you. Lots of inexpensive attorneys advertise on craigslist under the legal services portion. Maybe you can find a lawyer that can help you there. It is worth the money!
A biddable attorney can probably help you avoid jail time.
Sad to influence, but you will probably serve the 30 days. The judge told you what you needed to do, and you agreed; you also failed to comply with the agreement.
Granted nearby may have been extenuating circumstances, but you made a deal, if you weren't competent to keep up your end of the bargin, yuo shouldn't have agreed, or asked the referee for more time and possibly explained your situation. however whatever happens now is up to a intercede. But its fair to say you will be do 30 days.
