Can I sue my ex-wife for runing my credit. by not paying the house payments?
Ex-wife has one year to refinance the marital home, She according to the court is responsible for all payments. I am still on the loan. She default and forclosure follows. Can I sue her?
Yes and no. You cannot get the money from her for the house. You can however petition the courts to file a judgment against her for failure to pay. This is considered a violation of the court order. Typical punishments are three days in send to prison. Not really useful if she cannot pay due to lack of money.
Hell you can sue anybody, however put a copy of the court instruct in your credit report and a short letter explaining the situation. Good Luck. Dont go burn it down next to her in it. : )
