counter civil protection order?
if someone files a civil protection order against me which is false and the case is dismissed obviously since in attendance was no grounds for it. Am i able to sue for defamation of traits because this is on my public record?
Best Answer:
Probably not. An affidavit needs to be filed when issuing a protective proclaim. The person that filed the order feel they had grounds for a protective order at the time. It was probably dismissed due to want of evidence. If this is on your record, it should also state on there the charges was unsubstantiated and you should be fine. Most collectively it wouldn't appear on your record though. People are wrongfully accused of crimes they don't commit everyday. Its not fair, but that's why we enjoy the law and court systems for. It gives us our chance to prove our innocence or guilt. I personal have a feeling sometimes the laws aren't fair. Consult an attorney is your area because law are different state to state and/or country to country. In my state you could not sue. For your own good try to stay away from the person causing the trouble for you. You really don't call for that kind of drama in your life.
