Why are people still being held in Guantanamo bay?

It's been years! Surely they should have been tried or released by presently? How is the US government getting away with this?
Because there is a time of war going on against terrorism and they are terrorist, in essence prisoners of war. Common sense says that you don't release them so they can return to where on earth ever and commit more acts of terrorism. In past wars POWs be imprisoned until the conflict was over. I think the Supreme Court be wrong in ruling that the prisoners have a right to be tried in U.S. courts. The Court broke precedent when they made that ruling. With the ruin of the Cold War, not only was there no country to defy US military and economic power but diplomacy and the veneer of the American Dream were no longer required to seduce Non-Aligned countries. The US thugs will continue to indiscriminately plunder, snatch and murder until economic collapse forces them to withdraw to the virtual demilitarised state that existed between the World Wars.
They will not release them all. They will any get a guilty verdict (if ever tried) or keep anyone held there indefinitely. They won't release them all even if we all know that the sense they haven't been tried yet after all those years is because the US doesn't own any proof of them being a terrorist. Admitting that they did a mistake and keeping them in there for years lacking proof would be a huge scandal. Bush never admits that he does mistakes. Why would he start now? If McCain is elected, it won't change. Let's hope that if Obama is elected it will and things will be looked into. They are antagonist combatants captured on the battlefield who would murder you if given the chance. Some of these people enjoy been previously released only to be picked up again. So where do you stand? With the sanctuary of our soldiers overseas or with the legal rights these non-citizens (don't) have?

Because that way, Bush and company can pretend they are doing something give or take a few terrorism. If they release them and we discover that most are NOT terrorist, that will look VERY bad for the Republicans, won't it?

I would like to see Tony Blair and George Bush in Guantanamo Bay, in chains whilst they wait to be tried as War Criminals. But hey that'll never happen.
