Yes,he must know that you won't win ,and there probably won't be enough evidence or no evidence to your clam.At least he's not trying to take your money.

I've been a practicing lawyer for more than 25 years, and I agree with amy.mehta's answer. Another point is that litigation is a very stressful experience for the client. If your lawyer doesn't warn you off a bad case, you could waste a lot of time and energy (along with the money) for no purpose.

Yes. As a recent law school graduate I understand that it's a lawyer's duty not to bring frivolous cases. In other words, they can be in trouble if they bring cases that do not have any merit. In addition, it is not only embarrassing for the attorney bur for the client as well and could cost the client unnecessary expenses and could potentially result in the client having to pay the attorneys fees for the other side. Honesty by an attorney is important and to be valued. Unfortunately, I have no real life experiences in this area. However, I think the experience of learning about this in law school should suffice. Think about it? Would you rather have a lawyer who tells you the truth about the case or have him/her tell you that after you lose and spent all that money? Come on, you don't have to use that lawyer, you can find someone else.
