How do I seal my adult misdemeanor criminal records in california?
My case was in 1991.
I have completed the expungement process.
I have listed the California site with the appropriate forms for you to do that yourself. Good Luck! I have listed two of the links actually. The first explains the process and the second is the actual form.
Talk to a lawyer who's familiar with the process also contact the the Superior Court in your county for information.
Answer:
I assume from your question that you have obtained the relief available under Penal Code section 1203.4. Unfortunately, that is all the relief which is available to an adult in California. There is no 'sealing' procedure except for juveniles or adults who can show they were factually innocent (which, if you were convicted, you weren't).
My recommendation to those who have obtained 1203.4 relief is to state, if asked, if they have been convicted that a charge of [whatever it was] was dismissed under Penal Code section 1203.4, since that is what the record will show.
If your petition for expungement was successful, there's no need to have them 'sealed.' They're off your record.
If you did not receive and order of expungement, you're out of luck.
.
I think all criminal records should be permenant, no matter how small the offense. May encourage people to stay on the straight and narrow.
